    Vice President JD Vance named Microsoft on Thursday as the company that abused the foreign-worker pipeline harder than anyone else in the country, and Labor shut its green-card door.

    Vance freezes Microsoft’s green-card pipeline after 6,000 American layoffs

    The jump-off is the briefing already up on the community page: Vance on massive government fraud, and a direct order to Microsoft to stop firing Americans to hire foreigners. The visa piece is the one he put numbers on.

    Last year, Vance said, Microsoft laid off 6,000 American workers. In the same stretch the company took 6,300 H-1B visas and nearly 3,000 green cards. His math, said out loud at the Eisenhower Executive Office Building: for every American Microsoft cut, it brought in one and a half foreign workers he called indentured servants.

    “There has been no company in the United States, unfortunately, that has abused the system more than Microsoft.”

    Vance’s count, stated at the Oct. 8 briefing. One and a half foreign filings for every American layoff.

    The penalty is specific. The Department of Labor is suspending Microsoft from the Permanent Labor Certification program, PERM, the gate between a temporary H-1B and a green card. New applications will not be accepted. Pending ones will not be processed. Existing H-1Bs are not revoked by this order. The path to permanent residency is.

    That certification is the fraud he is charging, and it has the same shape as the rest of his task-force brief. A company that wants to sponsor a foreign worker for a green card has to tell Labor it looked for an American and could not find one. Vance said the look is a classified ad in a small-town paper. Nobody in that town was ever going to answer a Redmond software req. The silence becomes the file. The American who just got the layoff email is the person the ad was supposed to find.

    “The fraud is that they’re making representations when applying for this program that are fundamentally illegitimate and therefore ultimately illegal,” Vance said.

    PERM turns on a sworn search for an American. Vance says the search is a small-town ad nobody was meant to see.

    Microsoft did not immediately answer reporters. The company has said before that most of its H-1B filings are extensions for people already on the payroll, and that visa holders were among the people cut in the 2025 rounds. Those rounds ran past Vance’s 6,000 figure. Newsweek put the 2025 cuts near 16,000. Vance is using the number his task force tied to the same window as the visas and the green cards. He also said nearly 1,000 of the PERM filings were for the same jobs the Americans had just lost.

    Adobe is suspended too, on active federal investigations. So are the body shops that have run this model for a generation: Cognizant, Infosys, Tata, Wipro, HCL, and Capgemini. Labor Secretary Keith Sonderling said the department will not take new PERM filings from any of them and will not process the ones already in the stack.

    His ledger on those firms, going back to 2009: almost 3 million foreign-worker requests, more than 230,000 H-1B approvals, more than 100,000 permanent labor certifications. “That’s hundreds of thousands of jobs that were taken from American workers,” Sonderling said.

    Eight firms, one order. Sonderling said the group has requested nearly 3 million foreign workers since 2009.

    The same press conference opened a second front. Labor Inspector General Anthony D’Esposito said subpoenas are out to nine universities over J-1 visa use: Harvard, Yale, Stanford, Brown, the University of Pittsburgh, UC Davis, Caltech, Arizona State, and MIT. His charge is that schools used the exchange category to dodge employment rules, lean on taxpayer-funded programs, and undercut American wages. “Nobody will be getting a free pass because their name is carved into an expensive building.” He also said the IG will look at whether foreign influence or visa abuse is sitting on federally funded research.

    This is the visa chapter of the fraud brief Vance has been running since the president put him on it. He has put the task-force find near $250 billion. In September he and CMS chief Mehmet Oz said 750,000 ACA marketplace enrollees were cut off, a claimed $2.2 billion in subsidies, with another 419,000 still under review. Brokers got paid to feed names into a system that did not check whether the person existed or qualified. Medicare and Medicaid have the same hole: eligibility that was never really verified, including benefits going to people who are not citizens. Vance has called it basic that a person has to be an American to draw on those programs, and said the forms never enforced it.

    The visa freeze sits inside the larger ledger Vance has been selling. The $250 billion figure is his claim.

    Critics at the New York Times say that tally counts work that started before the task force existed and money that has not actually been recovered. The Minnesota feeding-program case, the one everyone knows, was charged in 2022. Vance’s answer has been that the programs were built without a real check, and somebody finally ran one.

    Thursday’s move does not need the disputed ledger. Microsoft told the government it could not find Americans. Then it laid Americans off and filed for foreigners. Sonderling shut the green-card door. Vance’s line to Redmond was short enough to put on a shirt.

    “You’re a great American company, but you’ve got to hire great American workers. You cannot lay off American workers and then replace them with foreign indentured servants.”

    Congress still writes the H-1B statute. Vance said so, and asked them to fix it. Until they do, the administration is using the certification step, the part where the company has to swear the job could not be filled here. That swear is now a federal investigation.
